Terms of Use
DEFINED TERMS
The Course is the Train Smarter and Harder Online Certificate Course.
The Participant is the person who is enrolled to complete the Course.
The Course fees are the fees for enrolment in the Course, including any relevant taxes or surcharges.
The Course materials are the learning materials provided in the Course, including:
- Video materials
- Lecture slides
- Quizzes
- Activities
- Spreadsheets
- Load Management eBook
- Any other materials provided to the Participant by Gabbett Performance Solutions for use in the Course, from time to time
GENERAL
1. By accepting these terms the Participant agrees to pay the Course fees for the Course using the payment method selected.
2. Course fees must be paid prior to enrolment in the Course. The Participant will not be granted access to the Course materials until full payment is made. Special offer coupon codes cannot be added to an enrolment retrospectively and must be added at the time of enrolment.
3. The approximate duration of the Course is stated on the course website. The approximate duration of the Course includes all written and video content and expected time to complete activities. Time estimates are determined based on consultation with accreditation providers.
COURSE MATERIALS, ACCESS AND ASSESSMENT
4. Course materials are supplied in an online environment, unless otherwise stated in the course description, and are available for viewing online and may not be downloaded.
5. The content of the online Course materials, including copyright and all other such intellectual property rights contained therein, remain the property of Gabbett Performance Solutions. The Participant may not reproduce any part of the online Course materials without the prior written consent of Gabbett Performance Solutions.
6. Course materials, course content and assessment are subject to change.
7. Course materials are provided online via Thinkific or via alternative means. The eLearning site may occasionally be unavailable during scheduled maintenance. In the event that our eLearning system becomes unavailable, course materials will be provided by another mode of delivery, if necessary.
8. Independent research beyond the course materials may be required to complete the activities within the course.
MODIFICATIONS TO THE COURSE AND FEES
9. Course fees are subject to change without notice.
10. Gabbett Performance Solutions reserves the right at any time to modify or discontinue the Course (or any part or content thereof) without notice at any time.
11. Gabbett Performance Solutions reserves the right to offer discounts, including group and institutional discounts, at its discretion.
12. Gabbett Performance Solutions shall not be liable to the Participant or to any third-party for any modification, price change, suspension or discontinuance of the Course.
PARTICIPANT ACCESS TO COURSE
13. In order to protect the intellectual property of Gabbett Performance Solutions, and to ensure the best learning experience possible for enrolled students, only the Participant may access the Course and the Course materials.
14. The Participant may not:
- Download the Course materials;
- Share the Course materials;
- Provide their login details to another person; or
- Otherwise attempt to share the Course with another person.
15. Gabbett Performance Solutions reserves the right to unenroll a Participant for breach of the above sections.
16. A Participant that is unenrolled from the Course for breach of the above sections is not entitled to a refund of Course fees.
COURSE WITHDRAWAL AND REFUNDS
17. The Participant may apply for a full refund of the Course fees when the following conditions are satisfied:
- The Participant requests a refund within 48 hours of enrolment; and
- Course materials have not yet been accessed; and
- The Participant has a legitimate reason for the refund, over and above a mere change of mind.
18. The Participant may apply for a half refund of the Course fees when the following conditions are satisfied:
- The Participant requests a refund within 2 weeks of enrolment; and
- The Participant has completed less than 25% of the course; and
- The Participant has logged into the course platform less than 10 times; and
- The Participant has a legitimate reason for the refund, over and above a mere change of mind.
19. No refund will be provided outside of the above circumstances, except at the discretion of Gabbett Performance Solutions exercised on a case-by-case basis.
CREDIT VOUCHER/COUPON CODE POLICY
20. All vouchers and discount coupons have the following conditions of use:
- Not redeemable for cash.
- Valid for one use only.
- Not valid with any other offer or voucher or coupon code.
- Pursuant to Clause 2, the coupon code must be entered at the time of enrolment. The discount cannot be applied at a later date.
- A coupon code can only be used in the time frame specified in the special offer.
CONFIDENTIALITY AND PRIVACY POLICY
21. Gabbett Performance Solutions will make reasonable efforts to keep any such information that Gabbett Performance Solutions holds about the Participant secure and to ensure that any of the employees or agents of Gabbett Performance Solutions who have access to information about the Participant do not make any unauthorised use, modification, reproduction or disclosure of that information.
22. Gabbett Performance Solutions will only disclose information that Gabbett Performance Solutions holds about the Participant:
- To the extent specifically required by law; or
- For the purposes of this agreement (including disclosing information in connection with any query or claim)
- Information provided by the Participant is considered confidential and will not be divulged to any third party, nor will it be sold.
COPYRIGHT AND INTELLECTUAL PROPERTY
23. For the avoidance of doubt, copyright in the material provided to the Participant is owned by Gabbett Performance Solutions and may only be used in the ways described in this section:
- The Participant may keep, read and annotate any notes provided to the Participant as part of the Course;
- The Participant may use the Gabbett Performance Solutions copyright material for research or personal use; and
- Unless otherwise stated, The Participant may not use the Gabbett Performance Solutions copyright material for commercial purposes including providing such material to third parties.
